General Terms and Conditions
1. Scope of application
The following General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all the orders placed via our Online-Shop in the version valid at the time of the placement of the order. Our Online-Shop is aimed exclusively at consumers.
A consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside the consumer’s trade, business or profession. A trader means a natural or legal person or a partnership with legal personality who or which, when concluding a legal transaction, acts in exercise of their trade, business or profession.

Any offering in the Online-Shop represents a non-binding invitation to order goods. You can initially place our products in the shopping basket on a non-binding basis and correct your entries at any time before sending your binding order by using the correction tools provided and explained in the order process. By clicking the order button, you are bindingly ordering the goods in your shopping basket. You will receive an e-mail confirming reception of your order immediately after you submit the order.
The time at which the contract with us is concluded depends on the payment method you have selected:
Apple Pay
The contract is concluded at the time of confirmation of the payment instruction to Apple Pay.
Invoice, SEPA direct debit
The contract is concluded upon our declaration of acceptance (order confirmation), which we send to you in a separate e-mail. The acceptance period is two working days from receipt of your order.
Credit/Debit card
Upon placing the order, you provide your credit or debit card details and the credit/debit card company carries out an authorisation check. After your identification as the rightful cardholder, the payment transaction is automatically initiated and your credit or debit card is charged upon placing the order. The contract with us is concluded at the time the credit or debit card is charged.
PayPal
During the order process, you will be forwarded to the website of the online payment provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. The contract with us is concluded at the time you confirm the payment instruction to PayPal.
Prepayment
The contract is concluded when we send you our confirmation of receipt of your order, in which we also provide you with our bank details.
TWINT
The contract is concluded at the time of your confirmation of the payment instruction to TWINT.
3. Contractual language, contract text storage
The contract can be entered into in German or English language. We save the text of the contract and send you the order data and our terms and conditionin text form. You can view the text of the contract in our customer login.
4. Prices, shipping costs, customs and delivery terms
All prices stated in our Online-Shop are in Euro and include the applicable statutory VAT.
Shipping costs may apply in addition to the indicated product prices. These are listed in our Online-Shop (www.FormMed.com) under "Shipping and Costs"and are also indicated in the order form.
We shall bear any additional customs duties, taxes and fees incurred for deliveries to Switzerland.
The delivery times stated by us are calculated from the time of receipt of your order, in the case of prepayment the day after your payment order has been issued to the transferring bank. Unless a different delivery time is stated for the respective goods in our Online-Shop, it is 1-3 working days for deliveries within Germany and to Austria and 2-5 working days for all other countries.
We only deliver by shipping and only to delivery addresses in Germany, other EU countries and Switzerland. Unfortunately, self-collection of the goods is not possible.
5. Payment
In our shop, we generally offer you the following payment methods in dependence on your country of residence:
Prepayment (Germany, other EU countries and Switzerland)
On selecting ‘Prepayment’ as the payment method, we will provide you with our bank details in the confirmation of receipt of your order and will ship the goods after receipt of payment.
Credit/debit card (Germany, other EU countries and Switzerland)
You provide your credit or debit card details when you place your order. Once you have been authenticated as the rightful cardholder, the payment transaction is automatically carried out and your card is debited.
PayPal (Germany, other EU countries and Switzerland)
During the order process, you will be forwarded to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your access data and confirm the payment instruction to us. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment instruction. You will be given further instructions during the order process.
PayPal Instalment Payment (Germany, other EU countries and Switzerland)
In cooperation with the online provider PayPal, we offer you the option of buying in instalments. The prerequisite for this is a successful credit check. Your creditworthiness will be checked by PayPal in real time. The instalment contract is concluded between you and PayPal. Apple Pay (Germany, other EU countries and Switzerland)
To pay the invoice amount via the payment service provider Apple, you must use the ‘Safari’ browser, be registered with Apple, have activated the Apple Pay function, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after the order has been placed. You will be given further instructions during the ordering process..
SEPA direct debiti (Germany and other EU countries)
By placing the order, you are granting us a SEPA direct debit mandate. We will notify you of the date of the debiting of your account (so-called prenotification). By submitting the SEPA direct debit mandate, we request our bank to initiate the payment transaction. The payment transaction is carried out automatically and your account is debited. The period for advance notification of the date of the account debit (so-called prenotification period) amounts to 6 banking days.
Invoice (Germany, Austria and Switzerland)
In this case, you pay the invoice amount after receiving the goods and the invoice by bank transfer to our bank account. We reserve the right to offer the purchase on invoice only after a successful credit check.
TWINT (Switzerland)
To pay the invoice amount via TWINT, you must have the TWINT app. After submitting your order, you will be redirected to the TWINT website, where you can authorise the payment using the TWINT app. You will be given further instructions during the order process.
6. Retention of title
The goods remain our property until full payment has been made.
7. Guarantees and warranties
The statutory warranty rights shall apply, in particular Sections 434 et seq. of the German Civil Code.
Information on any additional guarantees that may apply and their exact conditions can be found on the product and on special information pages in the Online-Shop.
8. Liability
We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, limb or health
• in the event of intentional or grossly negligent breach of duty
• in the event of guarantee promises, if agreed, or
• if the scope of application of the German Product Liability Act is established.
In the event of a breach of material contractual obligations, the fulfilment of which is essential to the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, on the part of our legal representatives or on the part of our vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected, unless we are liable without limitation in accordance with the preceding paragraph. Otherwise, claims for damages are excluded.
9. Applicable law
The law of the Federal Republic of Germany applies to the contracts concluded between you and us, to the exclusion of the UN Sales Convention. The statutory provisions on the restriction of the choice of law and the applicability of mandatory provisions of the state in which you have your permanent residence remain unaffected.
10. Code of Conduct
We have subjected ourselves to the Trusted Shops quality criteria, which can be viewed online at https://www.trustedshops.com/tsdocument/TS_QUALITY_CRITERIA_en.pdf.
11. Settlement of disputes
We are not obliged - and not willing - to participate in dispute resolution proceedings before a consumer arbitration board.
12. Withdrawal instruction
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is 14 days beginning from the day on which you or a third party named by you but other than the carrier has taken possession of the goods.
To exercise your right of withdrawal, you must inform us (FormMed HealthCare GmbH, Schönberger Weg 13, 60488 Frankfurt/Main, Germany, E-Mail: info@FormMed.de) of your decision to withdraw form this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund. We may withhold reimbursement until we have received the goods back from you or until you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

End of information on right of withdrawal
The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been broken after delivery.
